Terms of use for organisers
In force from 18 October 2026
These terms govern the use of the PinVia organiser area (organize.pinvia.it), where routes made of stops on a map are created and published. You accept them when you create your account from the invitation link and, if they change, the next time you sign in. People who follow routes with the app (player.pinvia.it) have no account and are not party to these terms. The Italian version is the reference text.
In short
- You can only join by invitation. Basic use, with images linked from other websites, is free.
- The media gallery and dedicated support are part of yearly paid subscriptions, agreed in writing and without automatic renewal. The app for people following routes is always free.
- Your content stays yours. You only give us permission to host it and show it in the app.
- You only publish what you have the right to publish, and you never ask people following routes for personal data.
- Your public name is shown as the author of the routes you publish.
- Stops must be in places people can reach safely.
- If content is illegal or breaks these rules we can hide or remove it, and we tell you why.
- You can close your account whenever you want.
1. Who provides the service
PinVia is provided by Stefano Bianchini, VAT number 04439480403 (“we”). For any communication about these terms write to info@pinvia.it. This is also the point of contact for authorities and users under Articles 11 and 12 of Regulation (EU) 2022/2065 on digital services (“DSA”). You can write to us in Italian or English.
2. The service
- In the organiser area you create routes made of stops on the map, with texts, images, YouTube videos and puzzles, and you publish them. Published routes open in the app, which is free, without ads and without sign-up.
- The free plan includes all features, with images linked from other websites. If it has limits (for example on the number of published routes), they are shown in the organiser area.
- The PinVia media gallery, where you upload images within the space shown on the Profile page, and dedicated support are part of the paid subscriptions described in section 3. We may also enable the media gallery free of charge, for example for a trial: in that case the duration and space we tell you apply.
- We may improve, change or remove features. If a change significantly reduces what you can do, we tell you in advance, as in section 14.
3. Paid subscriptions
- Proposal: price, duration, media gallery space, included services and VAT, where due, are set out in the written proposal we send you. The subscription is concluded when you accept it in writing, including by email. Where the proposal says something different, the proposal applies; otherwise these terms apply.
- Payment: by electronic invoice and bank transfer, within the times set in the proposal. There are no payments in the organiser area. For public bodies the proposal also includes the details required by public procurement rules (for example the CIG and the office's unique code).
- Duration and renewal: the subscription lasts one year, unless the proposal sets a different period, and does not renew automatically. Before it expires we send you a renewal proposal: the new period starts when you accept it and pay.
- On expiry, if you do not renew, the account and routes remain on the free plan. You can no longer upload new images; those already uploaded remain visible in routes for 60 days and are then deleted. We notify you by email before deleting them, and in the meantime you can replace them with images linked from other websites.
- Refunds: if we shut down the service before the expiry date, or if through our fault the media gallery remains unusable for a significant period, we refund the part of the fee for the period not enjoyed. If you close the account during the subscription, or we close it for a serious breach on your part (section 10), the fee already paid is not refunded, except for the right of withdrawal described below.
- Consumer right of withdrawal: if you are a consumer (a person paying for themselves, not for an organisation or for their trade or profession) and the subscription is concluded at a distance, for example by accepting the proposal by email, or off our premises, you can withdraw within 14 days of its conclusion, without giving reasons, by writing to info@pinvia.it (Articles 52 and following of the Italian Consumer Code). We refund you within 14 days of the withdrawal. If you asked us to start the subscription straight away, you only pay for the part of the period already provided (Article 57). Associations, schools, public bodies and professionals do not have this right.
4. Account
- Accounts are created only from the invitation link, which is personal. You must be of legal age. If you use PinVia on behalf of an organisation (association, school, museum, municipality, business), you confirm that you are authorised to do so: these terms also bind the organisation.
- Keep your password secret and do not share the account. If you think someone else is using it, change the password and write to us.
- The account name is public: it is shown as the author of published routes. It can be your name or the organisation's, and you change it from the Profile page. Your email is never shown.
- How we process account data is explained in the privacy notice.
5. Your content
- Texts, images, videos, puzzles and everything else you put in a route (“content”) remain yours or belong to whoever holds the rights.
- You give us a free, non-exclusive, worldwide licence to store the content, convert it into the formats needed (for example resizing and recompressing images) and show it to anyone who opens the route, in the app, via the link or the QR code. The licence only serves to run PinVia: we do not sell your content and do not use it to promote PinVia without asking you.
- The licence ends when you delete the content or the route, or close your account. Temporary copies (for example those saved on phones for offline use) may remain for a while and then disappear on their own.
6. What you guarantee about your content
By publishing content you confirm that you have the right to do so. In particular:
- Copyright: texts, photos, drawings and videos are yours, belong to someone who gave you permission, or are used in a way the law allows (for example a short quotation with its source, Article 70 of Italian Law 633/1941, or content under an open licence whose conditions you follow).
- Recognisable people: for photos and videos where people can be recognised you have their consent, where the law requires it (Articles 96 and 97 of Law 633/1941 and the GDPR). For minors you need the consent of whoever holds parental responsibility.
- Cultural heritage: images of public cultural heritage (museums, monuments, archives) can be freely shared for non-profit purposes. If the route has a commercial purpose, you request authorisation from the body in charge of the item and pay any fee (Articles 107 and 108 of the Italian Cultural Heritage Code, Legislative Decree 42/2004).
- Images and videos from other websites: if you link an image hosted elsewhere, you have permission to do so and you know that if that website removes or changes it, the app will no longer show it or will show it differently. Every night we check that linked images can be reached and warn you in the organiser area if they cannot. Videos are shown with the YouTube player and are also subject to YouTube's terms.
- Other people's personal data: if your content includes other people's personal data (names, photos, contact details), you are the controller of that data and you are responsible for it.
7. What may not be published
Illegal content is not allowed, nor is content that:
- infringes other people's copyright, trademarks, image rights or privacy;
- offends, threatens, defames, or incites hatred or violence;
- is pornographic, sexually explicit or otherwise unsuitable for an audience that may include minors;
- contains other people's personal data without a valid legal basis, or private contact details;
- is misleading advertising, spam, a scam, or links to malicious software;
- encourages dangerous or illegal behaviour (see section 8).
Also:
- Do not ask people following routes for personal data, for example with a puzzle asking for a name, email or phone number, or a link to a form that collects them. The app is anonymous and must stay so.
- Do not try to access other people's accounts or data, overload the service, get around its limits or use it in an automated way without our agreement.
8. Safety of places and events
- Put stops in places open to the public, or where you have the owner's permission. Do not put stops in dangerous spots (edges of busy roads, railway tracks, cliffs, building sites, deep water) and do not ask people to climb fences or ignore prohibitions.
- If the route has difficult sections (trails, climbs, areas without mobile signal), say so in the description. Remember that people following the route look at their phone while walking: choose places where they can stop.
- If you organise an event (a treasure hunt with many people, a contest with prizes), you are the organiser: you are responsible for permits, insurance and other legal obligations. Contests with prizes promoted by businesses may be prize promotions governed by Italian Presidential Decree 430/2001.
- Puzzle answers and hidden stops are part of the game but are not technically secret: someone with technical skills can find them. Do not tie valuable prizes or confidential information to a puzzle.
9. Publishing, links and QR codes
-
A published route can be seen by anyone who opens it. The link and QR code of a route
(
player.pinvia.it/p/…) stay the same over time, even if you edit the route. - An unlisted route does not appear among nearby routes in the app, but anyone with the link or QR code can still open it: it is not a way to keep it private.
- Route statistics are anonymous daily counts (starts, stops reached, finishes) and may be incomplete: they are not an exact measure of participants.
- If you unpublish or delete the route, the link and QR code stop working. People who had already saved it on their phone may see a copy until the app updates.
10. Reports and moderation
We do not check content before it is published, and the law does not require us to. We act when we receive a report or otherwise become aware of content that is illegal or breaks these terms. Decisions are always made by a person: we do not use automated systems to assess content. The only automated check is the one on images linked from other websites (section 6), which only produces a warning.
- Reports: anyone can report content by writing to report@pinvia.it, also from the app (“About and privacy”), with the route link, the stop and the reason. We tell the reporter the outcome, without giving them your details.
- What we can do, in proportion to how serious the problem is: no action if the content is lawful; hide the route, which disappears from the app, link and QR code until you fix it; delete it in serious cases; suspend the account for serious or repeated breaches, or if the account is used for abuse; close the account in the most serious cases.
- Reasons: when we hide a route you see the reason in the organiser area; for other decisions we write to the account email. We tell you which content, which rule or law, and what you can do (Article 17 DSA).
- Complaints: if you disagree with a decision you can reply to the email or write to info@pinvia.it within six months. We review the decision and reply, usually within 14 days. You can always go to court or use the other remedies provided by law.
- If we become aware of a crime that threatens people's life or safety, we inform the authorities (Article 18 DSA). We cooperate with authorities that ask us to, as provided by law.
11. Availability of the service
- PinVia is run with limited means. We do our best to keep it working, but we do not guarantee that it will be available without interruptions or errors: there may be maintenance, faults or problems with external services (maps, image websites, YouTube). For subscriptions, the support and response-time commitments set out in the proposal also apply.
- We do our best to keep your data, but keep a copy of the texts and images you care about.
- The app shows the map and the phone's position as provided by map services and the phone: they may be inaccurate. People following a route remain responsible for where they go and how they move.
12. Liability
- You are responsible for the content you publish and for how you use the service. If a third party claims damages from us for your content that breaks these terms or the law, you hold us harmless from damages and reasonable costs, including legal costs, to the extent the breach is due to you.
- We are liable for damage caused intentionally or by gross negligence and for personal injury. Otherwise, to the extent permitted by law: on the free plan we are not liable for service interruptions, loss of content or indirect damage; with a subscription we are not liable for indirect damage and are liable for other damage up to the amount of the fee paid in the previous 12 months.
- We are not responsible for the content you publish, nor for that of the external websites you link, except where the law makes us liable as a hosting service (Article 6 DSA).
- If you are a consumer (a person using PinVia for purposes outside their trade or profession), all the rights given to you by the Italian Consumer Code (Legislative Decree 206/2005) and by the law of your country remain unaffected, and no clause in these terms limits them.
13. Duration, withdrawal and closing the account
- These terms apply as long as you have an account. You can close it whenever you want, free of charge, by writing to privacy@pinvia.it from the account email. Within 30 days we delete the account, the routes and the images uploaded to the media gallery, except what we must keep by law (for example subscription invoices, for 10 years). If you close the account during a subscription, the refund rules in section 3 apply. Before asking, copy anything you need.
- We may close an account with at least 30 days' notice, for example if we shut down the service or the account has not been used for more than two years. We may suspend or close it immediately, without notice, for the serious or repeated breaches described in section 10 or if the law or an authority requires it.
- While the account is suspended you cannot sign in and your routes may be hidden. We tell you the reason and you can complain as in section 10.
14. Changes to these terms
We may change these terms to follow changes in the law, in the service or its features, or for security reasons. We notify you by email at least 30 days before the changes take effect, except when they are needed immediately by law or for security. The new version is published on this page with its date, and we ask you to accept it the first time you sign in. If you do not agree you can close your account before it takes effect, as in section 13, free of charge. Changes do not alter the price or what is included in a running subscription until it expires.
15. Governing law and disputes
- These terms are governed by Italian law.
- If you are a consumer, disputes go to the court of the place where you live or are domiciled, if it is in Italy; if you live in another EU country, the protective rules of that country remain unaffected.
- If you are not a consumer (for example if you act for an organisation or for your business), the court of the place where the provider resides has jurisdiction.
- Before going to court, write to us: we will try to solve the problem together. Alternative dispute resolution procedures provided by law always remain available.
16. Other information
- If a clause turns out to be invalid, the others remain valid.
- These terms are also available in Italian. If the two versions differ, the Italian text prevails.
- We keep the version and date of the terms you accepted. Previous versions are available on request.
